Ecology Realtor organizes a monthly recycling-themed contest called the 'Monthly Contest,' which includes a recycling requirement and a grammar-based game (together referred to as the 'Contest')
A: (3.01.25 - 3.31.25) The Monthly Contest begins on the 1st of the month at 12:00:00 AM PST and ends on the last day of the month at 11:30:00 PM PST (the "Monthly Contest Period").
B: The Monthly Contest is open to Entrants (as defined below) who complete their recycling or coordinate API between the 1st of the month at 12:00:00 AM PST and the last day of the month by 11:30:00 PM PST and have the lowest Grammar Game (Section 5) score by 11:30:00 PM PST on the last day of the month.
For example, the Monthly Contest Period for March 2025 requires you to complete your recycling or coordinate API between 12:00:00 AM PST on Saturday, March 1, 2025, and 11:30:00 PM PST on Monday, March 31, 2025, and achieve the lowest Grammar Game (Section 5) score between 12:00:00 AM PST on March 1 and 11:30:00 PM PST on March 31 to be eligible to participate in the Monthly Contest.
This promotion is sponsored by Ecology Realtor, located at 1968 S. Coast Hwy, Laguna Beach CA 92651 | #000 (“Sponsor” or “Ecology Realtor”). Apple and its affiliates are not a sponsor. Google and its affiliates are not a sponsor. Landlords, property managers and its affiliates are not a sponsor.
A: By participating, entrants (individually an “Entrant” and collectively “Entrants”) agree to be fully unconditionally bound by these Rules and represent and warrant that they meet the eligibility requirements set forth herein. In addition, Entrants agree to accept the decisions of Sponsor as final and binding as it relates to the Contest. The Contest is subject to all applicable federal, state, and local laws. Sponsor in its sole discretion, reserves the right to disqualify any Entrant it finds to be tampering with the Ecology Realtor App (as defined below) or is otherwise in violation of these rules.
B: The Contest is open to legal residents of the U.S.A who are eighteen (18) years of age or older at the time of entry. The Contest is subject to all applicable federal, state, and local laws. Void where prohibited. Entrants based in Colorado, Connecticut, Maryland, Nebraska, Arizona, and North Dakota are ineligible for the Contest.
C: Employees, agents, agent staff, officers, and directors (including immediate family members) of Sponsor, including its affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, contractors, printers, web design, and advertising and promotion agencies, and any and all other companies or individuals associated with the administration, development, fulfillment and execution of this Contest (collectively, "Promotion Parties") are not eligible to participate.
The term "immediate family member" includes spouses, grandparents, parents, siblings, children, and grandchildren and "step" of each. In addition, those living in the same households (those persons whether related or not who live in the same residence for at least three (3) months during the twelve-month period preceding the start date of the Contest) are not eligible to participate in this Contest.
D. Entrants are eligible to win the Monthly Contest only once per month.
E. All entries become the sole property of Sponsor and will not be returned.
A: To enter the Monthly Contest:
Download The Ecology Realtor app (the “Ecology Realtor App”) and sign up.
Pay the In-app Purchase (“Service Fee”) as specified in our Terms and Conditions (Currently., $69.99).
Recycle or submit coordinated API on time (as outlined in Section 2).
Participate in the Monthly Contest grammar-based game (the “Grammar Game”) and strive to be the quickest to complete the Grammar Game (Section 2).
This process ensures fairness for all participants. Service Fees are non-refundable, as specified in our Terms and Conditions under the "In-app Purchase" section. By installing our app, you agree to our Terms and Conditions, Privacy Policy and Cookie Use.
B. The Sponsor uses the Stopwatch class in C# to accurately measure the time it takes an Entrant to complete the grammar-based game . It provides high-resolution timing to ensure accuracy and fairness.
A: Contest Winners (as defined below) of the applicable Monthly Contest will win prizes set forth in section 6a1 during the applicable Monthly Contest Period (the “Monthly Contest Prize”). Section 6a1 prizes PDF is available by clicking HERE.
B: The Monthly Contest Prize is referred to as the “Prize.”
C: Subject to this Section 6, contest winners of the Monthly Contest will receive the Prize (if cash) via CashApp (or equivalent) at the end of the applicable Monthly Contest Period (Section 2) or within 14 days thereafter. Some prizes (e.g., living rent-free ) require a background check, and if the background check is negative, such Contest Winners may be disqualified (at Sponsor's sole discretion) and refunded in full.
D: Prizes are non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner. No substitution of the prize or transfer/assignment of the prize to others by the winners is permitted.
E: If the Contest Winner (as defined below) is unwilling or unable to accept the Prize requirements (e.g., negative background check, Unreachable), such Contest Winners shall be disqualified, and all privileges otherwise due as a Contest Winner shall be terminated. An alternative Contest Winner may be chosen from among all of the remaining eligible entries received if time permits, at Sponsor's sole discretion (as further detailed in Section 7(b) below).
A: Selection. The Sponsor will select a winner of the Monthly Contest based on the Entrant who recycles or submit coordinate api on time (Section 2) and completes the grammar game in the least amount of time during the Monthly Contest Period (Section 2).
To ensure fair play in the grammar game, the sponsor utilizes C#'s Stopwatch class to record each entrants completion time in milliseconds. Any entrant found tampering with their system to manipulate these times will be disqualified and banned from future participation.
B: Notification. Sponsor or its designated representative will make a minimum of three (3) attempts to contact the eligible Contests Winners by way of either push notification sent through the Ecology Realtor App, email, text message, or phone call as described in Section 6c (the “Identification Date”).
If an eligible Contest Winner cannot be contacted by or before the relevant Identification Date, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to be a Contest Winner) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate eligible Contest Winner.
C: In the event that two or more entrants complete the Grammar Game in the same amount of time, a tiebreaker will be required to determine the winner. The specific number of winners for the contest is outlined in Section 6a1. Tiebreaker contestants are competing to claim the rank they are on exclusively.
Example scenary:
Prizes: Four prizes ( Top four positions) first through fourth place. If two or more participants tie for a specific rank, a tiebreaker is conducted exclusively among the tied contestants to determine who secures that rank. The winner of the tiebreaker claims the contested position, while the loser is eliminated from the prize standings and does not assume any subsequent ranks.
Participants: Alice, Bob, Tom, Joe, and Sean
Initial Results: Alice and Bob are tied for first place; Tom is in second place; Joe is in third place; Sean is in fourth place.
Tiebreaker Process:
Alice and Bob compete in a tiebreaker to determine the first-place winner.The winner of the tiebreaker secures first place. The loser of the tiebreaker is eliminated from the prize rankings and does not occupy any of the remaining positions.
Final Rankings:
First Place: Winner of the tiebreaker between Alice and Bob
Second Place: Tom
Third Place: Joe
Fourth Place: Sean
This approach ensures that tiebreakers are decisive for specific ranks without altering the overall ranking structure or affecting the positions of other participants. It maintains quickness, fairness and clarity in the prize distribution process.
Eligible entrant's are responsible to monitor their communication channels (push notifications, email, text messages, phone calls) for tiebreaker notifications.
Eligible entrants will have 72 hours to complete a tiebreaker. Notifications will be sent via push notification, email, text message, or phone call (refer to Section 6e and Section 7b for details).
A: Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Contest should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such a case, Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest, Ecology Realtor App, or violates these Contest Rules.
B: Sponsor has the right, in its sole discretion, to maintain the integrity of the Contest, to void entries for any reason, including but not limited to: (i) multiple accounts from the same user from different email addresses; (ii) the use of bots, macros or scripts, or other technical means for entering/sharing; or (iii) Entrant’s use of untruthful, false or fraudulent information.
C: Any attempt by an Entrant to deliberately damage the Ecology Realtor App or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
Entrants represent and warrant that they are eligible to enter this Contest, and that all information provided to Sponsor is true, complete and correct. Sponsor makes no warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability, or fitness for a particular purpose (unless Sponsor provides the Contest Winner with written warranties). Further, no responsibilities are accepted for any additional expenses, omissions, delays, or acts of any government or authority. Void Where Prohibited.
Entrants agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, form (i) such entrant’s participant in the Contest and/or his/her acceptance, possession, use or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to, the malfunctioning of any computer, cable, network, hardware, or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the Contest; (v) electronic or human error which may occur in the administration of the Contest or the processing of winners.
Entrants agree to indemnify, defend, and hold Sponsor and its affiliated entities and their respective officers, directors, members, managers, employees, contractors, attorneys, assigns, representatives and agents harmless from and against any damage, cost, loss, liability and expense (including, without limitation, attorneys’ and experts’ fees and costs) incurred in connection with any third-party claim (whether judicial or non-judicial), demand, or action (each, a “Claim”) alleging facts or circumstances that, if true, would constitute: (i) a breach of any representation, warranty, or other obligation contained in these Contest Rules by Entrant, (ii) the negligence or willful misconduct of Entrants as any part of their participation in this Contest.
A: Except where prohibited, Entrants in the Contest and acceptance of Prize constitutes each winner's permission for Sponsor and Sponsor’s affiliates to use his/her name, address (city and state only), likeness, photograph, picture, portrait, voice, biographical information, and/or any statements made by each Contest Winner regarding the Contest, or Sponsor for advertising or promotional purposes without notice or additional compensation.
B: Entrants further agree that their names may be displayed by Sponsor on a winners list.
THIS CONTEST IS GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in San Jose, California. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, and participant further waives all rights to have damages multiplied or increased.
